The short version
- A guide, not a guarantee. Trail data can be wrong or out of date. You are responsible for riding safely and legally, and posted signs and land-manager rules always win.
- Premium is optional. Many features are free. Premium is an auto-renewing subscription billed by Apple or Google, with the price and length shown before you buy.
- It renews until you cancel. Cancel at least 24 hours before the end of the current period in your App Store or Google Play settings. Deleting the app does not cancel it.
- Your rides are yours. Bikes and recorded rides stay on your device. If you share a trail or comment, you give us permission to show it to other users.
- Be decent. No abusive, unlawful or dangerous content. We remove it and can suspend accounts that post it.
These Terms of Service (the “Terms”) are an agreement between you and E-Bike Trails, LLC (“we,” “us,” “our”) for the E-Bike Trails mobile app for iOS and Android (the “App”), any Premium subscription, and this website. By downloading, installing or using the App, buying Premium, or using this website, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the App.
01 Who can use the App
You must be at least 13 years old, or older if the law where you live requires it. To buy Premium you must be old enough to form a binding contract where you live, or have permission from a parent or guardian who manages your Apple or Google account. The App is offered by E-Bike Trails, LLC, the seller named on our App Store and Google Play listings.
02 Your license to use the App
We give you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal, non-commercial recreational use, subject to these Terms. We keep all rights not expressly given to you. The App is licensed, not sold.
You agree not to:
- copy, modify, reverse engineer, decompile or try to extract the source code of the App, except where the law allows it despite this restriction;
- bulk-download, scrape or systematically copy map tiles, trail data or other content the App loads, or use the App to build a competing database or service;
- bypass, disable or tamper with Premium, purchase verification, usage limits or any security feature;
- resell, rent, sublicense or share your Premium access in a way the store’s rules don’t allow;
- interfere with the App, our servers or the services we rely on, or use the App in a way that breaks the law or harms others; or
- use the App to guide commercial tours or for any other commercial purpose without our written permission.
You are responsible for any mobile data charges and for keeping your device and operating system reasonably up to date.
03 Safety and riding responsibly
Riding an e-bike is risky. You ride at your own risk.
- Ride within your ability and the conditions. Wear a helmet and protective gear, keep your bike and battery in good condition, and know your e-bike’s class and the rules that apply to it.
- Don’t handle your phone while riding. Ride recording keeps running when your phone is locked, so mount your phone securely or stow it, and stop in a safe place before you look at it.
- Don’t rely on the App for emergencies. It can’t call for help or alert anyone if you are in trouble. Cell service and GPS can be weak or missing in remote areas, so carry backup navigation, water, tools and a way to call for help, and tell someone your plan.
- Check before you go. Look for closures, fire restrictions, weather, seasonal limits and private land. Posted signs and the rules of the land manager always take priority over anything in the App.
04 Trail, map and ride information
Where it comes from
Trail and road information in the App comes mainly from U.S. Forest Service Motor Vehicle Use Maps (MVUM), the U.S. Bureau of Land Management (BLM) map data and other public sources, and may include information we compile from sources such as land-manager websites and trailhead postings. Basemap tiles come from OpenFreeMap and OpenStreetMap contributors.
It can be wrong
This information can be incomplete, out of date, simplified or inaccurate. A trail may be shown as open, or as suitable for e-bikes, when it is not. Vehicle types, e-bike class designations, seasonal restrictions and closures change often and differ between land managers. “No data” means we don’t have the information, not that riding is allowed. Trail lines and your position on the map are approximate and may not match the ground.
We are not a land manager and we don’t grant permission to ride anywhere. You are responsible for finding out where you may legally ride and for following all laws, regulations and posted rules, including any fines or citations that result from not doing so.
Estimates only
Distance, elevation gain and loss, and similar figures come from your phone’s sensors and can be off. Battery information is whatever you enter. Don’t use these figures to decide whether you have enough battery or energy to get back.
Attribution
Map data © OpenStreetMap contributors. Trail data from the U.S. Forest Service and the U.S. Bureau of Land Management. Other trademarks and data belong to their owners.
05 Your bikes, rides and saved trails
You can add bike profiles, record and edit rides, and save trails to a “Ride Later” list. Free users can save up to 10 trails, and Premium allows more. We may change these limits. Your bikes and recorded rides are stored on your device; see the Privacy Policy. If you delete the App, reset or lose your phone, that data may be lost, and we cannot recover it. You are responsible for keeping your own backups.
Directions links open Google Maps or Apple Maps on your device. Routes to a trailhead may include roads or paths that aren’t suitable for your vehicle, so use your own judgment. Those apps are governed by their own terms.
We use your recorded rides only as described in the Privacy Policy. Recording continues while your phone is locked until you end the ride, as explained there.
06 Premium subscriptions
Many features of the App are free. We also offer an optional paid subscription called Premium that unlocks additional features. This section explains how Premium works.
| Premium at a glance | Details |
|---|---|
| What it is | An optional, auto-renewing subscription that unlocks Premium features in the App. |
| What’s included | The Premium features described in the App when you subscribe. These may include unlimited saved trails (Ride Later), additional e-bike trail information that we compile and host, and other features we add. |
| Length and price | Shown on the purchase screen before you subscribe, including the billing period (for example, yearly) and the price in your local currency. |
| Who bills you | Apple (App Store) or Google (Google Play), through your store account. We don’t receive your card details. |
| Renewal | Renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. |
| How to cancel | In your App Store or Google Play subscription settings. See How to cancel. |
Purchases and billing
Premium is sold through the App Store or Google Play using their in-app purchase systems. Payment is charged to your Apple ID or Google account when you confirm your purchase. Apple and Google process the payment and handle taxes, receipts and billing questions. We use RevenueCat, a subscription-management service, to confirm which purchases are active so the App can unlock Premium; see the Privacy Policy for how that works.
Automatic renewal
App Store subscriptions: Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically unless it is canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price then in effect.
Google Play subscriptions: Your subscription renews automatically at the end of each billing period and your Google payment method is charged until you cancel.
Free trials, launch discounts and other offers
We may offer free periods, discounted launch pricing, early-supporter offers or other promotions. The length of the offer, and the price you will pay after it ends, are shown when you sign up. Unless you cancel at least 24 hours before an offer ends, your subscription continues and you are charged the regular price. Any unused portion of a free trial is forfeited when you buy a subscription, where the store applies that rule. Offers may be limited in time or quantity, and may be limited to one per person or account.
Price changes
We may change Premium prices. A change does not affect the period you have already paid for. If a price increase applies to your subscription, Apple or Google will notify you and, where their rules require, ask for your consent. If you don’t agree, cancel before your next renewal. Where consent is required and you don’t give it, your subscription may stop renewing.
How to cancel
You can cancel at any time. Cancel at least 24 hours before the end of the current period to avoid being charged for the next one. You keep Premium until the end of the period you’ve paid for.
- App Store: on your iPhone or iPad, open Settings, tap your name, then tap Subscriptions, choose E-Bike Trails, and tap Cancel Subscription. You can also manage subscriptions from your Apple account in the App Store.
- Google Play: open the Google Play Store app, tap your profile picture, then Payments & subscriptions, then Subscriptions, choose E-Bike Trails, and tap Cancel subscription.
Deleting the App, or ending your use of this website, does not cancel your subscription. Because Apple or Google handles billing, we generally can’t cancel your subscription or change your billing for you.
Refunds
Except where the law or the store’s policies say otherwise, purchases are final and we don’t give prorated refunds for unused time. Apple and Google control refunds for their stores. To ask for one, use Apple’s “Report a Problem” page (reportaproblem.apple.com) for App Store purchases, or your Google Play order history and Google Play help for Google Play purchases. Nothing in these Terms limits any legal rights you may have under your local consumer-protection law, such as a right to cancel.
Restoring Premium on a new device
Premium is tied to your Apple ID or Google account, not to a separate E-Bike Trails account. If you reinstall the App or get a new phone, sign in to the same store account and use Restore Purchases in the App. A subscription bought on one platform may not carry over to the other (for example, from iOS to Android).
Changes to Premium
We may add, change or remove Premium features, and may move features between free and Premium. We will try to give notice of any significant reduction during your paid period, and you can cancel at any time.
07 Third-party services
The App relies on services run by others, and their terms and policies apply to your use of them. They include Apple and Google (app stores, in-app purchases, and their maps apps), RevenueCat (subscription management), the U.S. Forest Service and the U.S. Bureau of Land Management (trail data) and OpenFreeMap and OpenStreetMap contributors (map data). Our Privacy Policy explains what information these services and this website receive. We don’t control these services and aren’t responsible for them, and they may change or become unavailable.
08 Our rights and your feedback
The App, the website, our compilation of trail information, and our logo, name, designs and software are owned by us or our licensors and protected by law. Public-domain government data and open map data remain subject to their own licenses. If you send us ideas or feedback, we may use them without owing you anything. If you believe something in the App or on this website infringes your rights, email us at the address below with the details.
09 Disclaimers
The App, the website, trail and map information, and Premium are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don’t promise that the App will be uninterrupted, error-free or secure, that any trail is open, legal or safe to ride, or that recording will capture your whole route. Some places don’t allow certain disclaimers, so some of this may not apply to you.
10 Limits on our liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of use, and we are not liable for injury, property damage, fines, citations or other loss arising from your riding or from your reliance on information in the App or in Shared Content. Our total liability to you for any claim relating to the App or these Terms is limited to the greater of the amount you paid us for Premium in the 12 months before the claim and US$50.
Nothing in these Terms excludes or limits liability that can’t be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence where the law doesn’t allow it to be limited. If you live in the European Economic Area, the United Kingdom or another place with mandatory consumer rights, you keep those rights.
11 Your responsibility to us
To the extent the law allows, you agree to cover us for claims, losses and costs (including reasonable legal fees) that come from your breach of these Terms, your Shared Content, or your violation of law or of someone else’s rights.
12 Suspension and ending your use
You can stop using the App at any time. We may suspend or end your access if you break these Terms, put others at risk, or misuse Premium or the community features, or if we stop offering the App. Ending your use does not cancel a subscription, which you must cancel in your store settings. Sections that by their nature should continue (such as ownership, disclaimers, limits on liability and governing law) will continue after these Terms end.
13 App Store and Google Play terms
If you got the App from the Apple App Store
- These Terms are between you and us only, not Apple. We, not Apple, are responsible for the App and its content.
- Your license is limited to use on Apple-branded products that you own or control, as permitted by the App Store’s usage rules.
- We, not Apple, are responsible for providing maintenance and support. Apple has no obligation to provide any.
- If the App fails to meet any applicable warranty, you may tell Apple, and Apple will refund the purchase price of the App if there is one. To the fullest extent the law allows, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for any claims relating to the App or your use of it, including product-liability claims, claims that it fails to meet a legal requirement, and consumer-protection or privacy claims.
- If a third party claims that the App infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending and settling the claim.
- You confirm that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist-supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.
- You must follow any applicable third-party terms, such as your wireless data service agreement, when using the App.
- Questions, complaints or claims about the App can be sent to us at contact@e-biketrails.com.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept them, Apple will have the right to enforce them against you as a third-party beneficiary.
If you got the App from Google Play
Your purchase and download are also subject to the Google Play Terms of Service. Google is not a party to these Terms and isn’t responsible for the App or its support.
14 Governing law and disputes
These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-law rules. Courts located in Utah have exclusive jurisdiction over disputes about these Terms or the App, except that if you are a consumer, you may also have the right to bring claims in the courts where you live and to rely on the mandatory consumer laws of your home country. Before filing a claim, please contact us so we can try to work it out.
15 Changes to these Terms
We may update these Terms as the App grows, for example when we add or change features or Premium. When we do, we will change the “Last updated” date above, and if the changes are significant we will let you know in the App or on this website. If you keep using the App after a change takes effect, you accept the updated Terms. If you don’t agree, stop using the App and cancel any subscription.
16 General
These Terms and the Privacy Policy are our complete agreement with you about the App. If a part of these Terms is found unenforceable, the rest still applies. If we don’t enforce a right, that doesn’t waive it. You may not transfer your rights under these Terms, but we may transfer ours as part of a merger, sale or reorganization. We may give you notices by posting them in the App or on this website, or by email if you have given us your address.
